Microsoft Product Terms Updates – Nov & Dec 2025: Key Insights

Several Azure updates focus on clarity around AI services, hybrid entitlements, and customer responsibility:

  • Azure AI Search terms now explicitly notify customers of:
    • Use of First-Party Consumption services
    • Use of Web Knowledge Sources when using Grounding with Bing services
  • Added terms for open-source models offered as Azure Direct Models within Azure AI Foundry
  • Clarified that Azure Hybrid Benefit for Azure Local is not available when used with Microsoft 365 Local

Microsoft continues to tighten transparency around AI grounding, data sources, and entitlement boundaries. Organizations using Azure AI services should reassess internal AI governance and ensure usage aligns with the clarified sourcing and consumption terms.

Microsoft updated the Managed Services clause for Defender Experts to clarify:

  • Which components are classified as Core Online Services
  • Which components fall under Professional Services
  • Explicit customer consent requirements for Microsoft security experts to access data when delivering services

This change strengthens contractual clarity around data access and responsibility. Security teams should ensure internal approval and documentation processes reflect the updated consent requirements, particularly in regulated environments.

Microsoft updated Dragon Copilot terms to support the launch of Dragon Copilot for Nursing.

This reflects Microsoft’s continued expansion of Copilot into regulated, role-specific environments. Healthcare organizations should pay close attention to service-specific terms, especially where patient data and clinical workflows are involved.

Windows 365 Product Terms were updated to support:

  • Launch of Windows 365 Reserve
  • Addition of Microsoft 365 G3 and Enterprise Mobility + Security G3 as prerequisites for:
    • Microsoft Entra Internet Access
    • Microsoft Entra Private Access

These updates broaden eligibility and introduce new continuity options. Organizations using Windows 365 for resilience or frontline scenarios should review whether the new Reserve offering aligns with their DR and access strategies.

Microsoft updated Product Terms to support the release of:

  • SQL Server 2025
  • Visual Studio 2026

While largely expected, version launches often trigger downstream impacts during renewals, audits, or infrastructure refresh cycles. Early awareness helps avoid accidental deployment or entitlement gaps.

A new clause confirms that Dynamics 365 Business Central meets local certification requirements in Spain.

This provides assurance for organizations operating in regulated national environments, particularly where local certification or compliance alignment is required for ERP platforms.

Microsoft updated the link URL to the Terms of Use for:

  • Grounding with Bing Search
  • Grounding with Bing Custom Search

These services are available through Microsoft Enterprise Product Integrations.

While administrative, accurate linkage to AI grounding terms is increasingly important as Power Platform solutions incorporate external data sources and generative AI features.

Additional legal and definitional updates include:

  • Updated EU settlement notices addressing the availability of Office 365 and Microsoft 365 suites with and without Microsoft Teams for EEA customers
  • New Glossary definitions added for:
    • Covered Suites – These are the typical user subscription licenses bundles, such as Microsoft 365 E3 and E5, Office 365 E1 – E5 and the Microsoft 365 Business SKUs
    • (no Teams) Suites – These are the above without a Microsoft Teams license included

These changes formalise distinctions that already exist in practice. Organizations in the EEA should ensure procurement and contract documentation reflects the updated suite definitions.
